Terms of service
What you may do with the product, what we owe you, and how either of us ends it.
1. The agreement
These terms govern your use of Gamify Work. By creating an organization or using the service you accept them. If you accept on behalf of a company, you confirm you are authorised to bind it, and “you” means that company.
2. The service
Gamify Work receives events from systems you connect, aggregates them, ranks them on leaderboards you configure, and awards collectible cards against rules you set. We provide it as it is described on this site, and the integrations page carries an honest status for anything not yet complete.
3. What it costs
Prices are on the pricing page. The free plan covers up to fifty people and stops there rather than billing you. Beyond that, the Team plan is $5 per person per month, charged on seats, meaning the people who can use the product, counted from your organization’s membership list. Both plans include AI credits, and Team can use more past its included pool on a pay-as-you-go basis, reported and billed daily rather than monthly in advance, with an admin able to cap that spend.
The seat charge is by card through our payment processor, monthly in advance. An organization that grows beyond its plan’s limit is moved to the cheapest plan that can hold it, and we notify you of the new monthly figure when that happens. Shrinking back does not move you down automatically; the billing page offers it.
You can change plan or cancel from inside the product; cancelling takes effect at the end of the period and we do not refund part-months unless we have got something wrong.
4. Your account
You are responsible for who you invite, for what your administrators configure, and for keeping connector secrets secret. Rotate a secret promptly if it may have been exposed; rotation takes effect immediately and the old secret stops working.
5. Acceptable use
You agree not to:
- use the service to monitor individuals in a manner unlawful where they work, or to disguise surveillance as measurement;
- upload card artwork, names or text you do not have the right to use. The upload asks you to confirm this, and it is a warranty, not a formality;
- attempt to reach another tenant’s data, probe the service for vulnerabilities outside a disclosure we have agreed, or interfere with its operation;
- resell or provide the service to third parties as your own.
We may suspend an account that is doing any of these, and we will tell you why.
6. Your data
Your data stays yours. We process it to provide the service, on the terms in the DPA and the privacy policy. We do not sell it, and we do not use it to train models. You can export it and you can have it deleted, both from inside the product.
7. Content you upload
You keep ownership of custom card packs and anything else you upload. You grant us the licence needed to store, process and display it in the service for your organization, and nothing wider. If a rightsholder objects to something in your pack, we will contact you and may remove it while it is resolved.
8. Availability
We do not offer a service level agreement. The product is early, it is free, and promising an uptime figure we have no mechanism to stand behind would be dishonest. We will tell you about planned interruptions where we can.
9. Warranties
The service is provided as it is, without warranties of any kind beyond those that cannot lawfully be excluded. In particular we do not warrant that measurements are complete or that attribution is correct: both depend on what your connected systems send us and on how identities are linked.
Nothing produced by this service should be the sole basis for a decision about a person’s employment. We have said this as plainly as we can everywhere else on this site, and it belongs here too.
10. Liability
To the extent the law allows, neither of us is liable to the other for indirect or consequential loss, lost profits or lost data. Our total liability is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars. While the service is free, that is one hundred dollars.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
11. Ending it
You may stop at any time and ask us to delete your organization, which we will do. We may end this agreement with 30 days’ notice, or immediately if you materially breach these terms. If we end it without cause, we will give you a reasonable chance to export your data first.
12. Changes
We may update these terms. If a change is material we will give notice before it takes effect, and continuing to use the service after that counts as accepting it. The date at the top is the last time this page changed at all.
13. Contact
[email protected] for anything about these terms.
